1. Tour and rental agreement
The tour (and rental) agreement is only concluded upon a written/e-mailed
confirmation of participation by Tuscan Moto Tours (herein below
designated as the organiser)
2. Scope of services:
(1) The scope of services is ultimately derived from the website
content that is valid at the time of booking. All services that
are not specifically listed as included are not included in the
tour’s price.
(2) The organiser reserves the right to modify
the tour, in particular the tour route, as long as important reasons
make this necessary. The organiser shall thereby endeavour to leave
the tour’s characteristics unchanged and to perform equivalent
services.
3. Requirements of participation:
(1) Participants must have held a full motorcycle license for at
least two years, and it must be valid at the time of the tour.
(2) The participant must provide own safety equipment – Helmet,
gloves, leathers etc and is required to wear motorcycle riding gear
appropriate to the demands of the tour. It is mandatory that helmets
be worn, without exception.
(3) The participant must have adequate travel insurance to cover
possible, medical expenses, repatriation,cancellations etc.
The participant must notify the operator of any
medical problems and be responsible for their own medication.
Any rider considered to be over the alcohol limit
for riding will not be allowed to ride and will have to wait for
group to return.
No drugs (except prescription) will be allowed,
any rider found in possession will forfeit their place and will
be returned to starting point with no further access to motorcycles.
It is exclusively the participant’s responsibility
to judge whether his or her individual competence and capabilities
are sufficient to cope with the specified route. The organiser and
the tour guide are under no obligation to determine and verify the
participant’s competence and capabilities.
If the participant takes part in the tour with
his or her own motorcycle, then the participant bears the sole responsibility
for the vehicle being in perfect repair and in compliance with all
regulations and requirements stipulated by law and by the organiser.
The organiser and the tour guide are under no obligation to verify
the participant’s compliance with these requirements.
4 .Motorcycle rentals:
(1) The reservation of a motorcycle must take place at
the time of the tour booking. The rented motorcycle may be ridden
only during the participation in the booked tour.
(2) A security deposit of £1500 shall be paid, at the latest
upon taking possession of the rented motorcycle. The deposit will
be reimbursed upon the return of the motorcycle minus any repair
charges for damage. The rider will be liable for any damage exceeding
this amount if they are at fault for the accident. All costs for
damages will be paid by the client and reimbursed when the operator
receives payment from the insurers, less any excess incurred.
(3) The rental period shall not be suspended by any un usability
of the vehicle that is brought about through the fault or the incompetence
of the participant.
5. Infractions of the tour guide's instructions
or against traffic laws.
If the participant’s actions constitute a gross infraction
of the tour guide’s instructions or of traffic regulations,
the organiser can withdraw from the contract and take possession
of the rental motorcycle. In such an event, there will be absolutely
no reimbursement of the tour or rental price.
Payment:
Full payment must be made with the website booking form.
Withdrawal from and transfer of the agreement:
(1) The person making the reservation is entitled to withdraw
from the agreement at any time. If the person making the reservation
withdraws, then, the following cancellation fees will be charged
:
20% of the tour price in the
case of withdrawal in the period between the time of the reservation
and 8 weeks before the tour begins.
50% of the tour and rental price
in the case of withdrawal between 8 weeks to
4 weeks before the tour begins.
100% of the tour and rental price
in the case of withdrawal within 4 weeks of the tour’s commencement
or in the case of non-appearance without notification.
Notification of withdrawal
must be made via registered letter. The deadlines listed above refer
to the organiser’s receipt of the notification of withdrawal.
The participant is strongly advised to take out trip cancellation
insurance.
(2) The participant can transfer the contractual
relationship to another person, as long as s/he fulfils all the
prerequisites for participation and the organiser is notified of
the transfer within an appropriate period of notice before the tour
departs. There will be a £25 transfer fee in this event. The
transferor and the new participant are jointly and severally liable
for the unpaid fees as well as for any additional costs arising
from the transfer.
Cancellations:
(1) The organiser reserves the right to postpone or completely cancel
the tour for important reasons at any time. The participant shall
be immediately notified of the cancellation, in writing.
(2) In the event of the postponement or cancellation of a tour,
the participant has the right to ask the organiser for the choice
between either the reimbursement of the participation price or the
participation in another tour, provided that this is possible for
the organiser.
Liability
(1) The participant takes part in the tour at his or her
own risk. The organisers are not liable whatsoever for any injuries
sustained by the participant, fatal or otherwise.
(2) The organisers are not liable for any damage/ loss of any of
the participants belongings, however caused.
(3) Trip details,dates and or price may change
owing to hotel or operational requirements, event changes or unforeseen
events out of our control, i.e. Swimming pool or restaurant closure,
currency fluctuation,industrial action, civil unrest etc. The operator
reserves the right to make these changes.
